Terms of Use
1. Acceptance of Terms
By accessing, browsing, or using the Oxyforge website and hosting services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use our Services.
These Terms constitute a legally binding agreement between you (“Customer”, “you”, or “your”) and Oxyforge (“we”, “us”, or “our”). These Terms are governed by and shall be interpreted in accordance with the laws of Malaysia, the Republic of Singapore, and any applicable international laws and regulations.
2. Description of Services
Oxyforge provides cPanel-based WordPress hosting services powered by Google Cloud Platform infrastructure. Our Services include, but are not limited to:
- Web hosting and server provisioning
- cPanel access for website and server management
- WordPress installation and management tools
- Domain management and DNS services
- SSL certificate provisioning
- Email hosting
- Automated backups (provided as a courtesy only — see Section 9)
- Technical support
3. Account Registration and Security
To use our Services, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your account credentials (including cPanel login details) confidential and secure
- Accept full responsibility for all activities that occur under your account
- Notify us immediately at [email protected] of any unauthorized use of your account
You must be at least 18 years of age to create an account and use our Services.
4. Acceptable Use Policy
You agree to use our Services only for lawful purposes and in compliance with all applicable laws of Malaysia, Singapore, and any other relevant jurisdictions. You shall not use our Services to:
- Host, distribute, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable under the laws of Malaysia, Singapore, or any applicable international law
- Distribute malware, viruses, worms, Trojan horses, or any other malicious code
- Send unsolicited bulk email (spam) or engage in phishing activities
- Infringe upon the intellectual property rights of any third party
- Host content related to illegal gambling, piracy, or fraud
- Attempt to gain unauthorized access to other systems, networks, or accounts
- Engage in cryptocurrency mining or any process that excessively consumes server resources
- Store or distribute child sexual abuse material (CSAM) or any exploitative content
- Violate any applicable data protection or privacy laws, including the Malaysian Personal Data Protection Act 2010 (PDPA) and the Singapore Personal Data Protection Act 2012 (PDPA)
- Interfere with or disrupt the integrity or performance of our Services or servers
We reserve the right to suspend or terminate your account immediately and without notice if we determine, at our sole discretion, that you have violated this Acceptable Use Policy.
5. Resource Usage and Fair Use
All hosting plans are subject to fair use limits on CPU, memory, storage, and bandwidth as outlined in your selected plan. Excessive use of server resources that negatively impacts other customers or overall server performance may result in:
- Temporary throttling or suspension of your account
- A request to upgrade to a higher-tier plan
- Account termination in cases of repeated or severe abuse
We will make reasonable efforts to notify you before taking any action, except in cases of emergency or severe abuse.
6. Payment and Billing
- All fees are stated in the currency displayed at the time of purchase and are due in advance for the selected billing cycle.
- Payments are processed securely through our third-party payment processor. We do not store your complete credit card information on our servers.
- Failure to pay fees by the due date may result in immediate suspension or termination of your account without prior notice.
- We reserve the right to change pricing with at least 30 days’ notice. Price changes will apply to your next billing cycle.
7. No Refund Policy
ALL FEES PAID TO OXYFORGE ARE STRICTLY NON-REFUNDABLE. This includes, but is not limited to:
- Hosting plan fees (monthly, annual, or any other billing cycle)
- Domain registration and renewal fees
- SSL certificate fees
- Add-on services and upgrades
- Setup or migration fees
- Any other charges associated with your account
By purchasing any Service, you acknowledge and agree that no refunds, credits, or chargebacks will be issued under any circumstances, including but not limited to dissatisfaction with the Service, early cancellation, account suspension due to policy violations, or failure to use the Service during the paid period.
If you initiate a chargeback or payment dispute with your bank or payment provider, Oxyforge reserves the right to immediately suspend or terminate your account and pursue recovery of all amounts owed, including any administrative fees incurred as a result of the dispute.
8. Service Level Agreement (SLA) and Uptime
Oxyforge strives to maintain reasonable server uptime. However, you acknowledge and agree that our uptime commitment expressly EXCLUDES the following, and Oxyforge shall bear no liability for any downtime, interruption, or degradation of service arising from:
- Scheduled maintenance, server updates, patches, and system upgrades, which may occur at any time with or without prior notice
- Emergency maintenance required to address security vulnerabilities or critical system issues
- Downtime, outages, or performance degradation caused by third-party infrastructure providers, including but not limited to Google Cloud Platform (GCP), Cloudflare, content delivery networks (CDNs), DNS providers, domain registrars, and any upstream network providers
- Network outages, routing issues, or connectivity problems beyond our direct control
- Distributed denial-of-service (DDoS) attacks or other malicious activities targeting our infrastructure or your hosted content
- Force majeure events, including but not limited to natural disasters, pandemics, government actions, war, terrorism, power outages, telecommunications failures, or any other events beyond our reasonable control
- Issues arising from your own applications, scripts, plugins, themes, custom configurations, or third-party software installed on your account
- DNS propagation delays
- Hardware failures in third-party data centres
- Any regulatory or governmental action requiring service interruption
OXYFORGE MAKES NO GUARANTEE OF UNINTERRUPTED, ERROR-FREE, OR CONTINUOUS SERVICE AVAILABILITY. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOU ACKNOWLEDGE THAT TEMPORARY SERVICE INTERRUPTIONS MAY OCCUR AND AGREE THAT OXYFORGE SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR COSTS ARISING FROM SUCH INTERRUPTIONS.
9. Data, Backups, and Content Ownership
You retain full ownership of all content and data you upload to our servers. Oxyforge does not claim any intellectual property rights over your content.
9.1 Backup Disclaimer
WHILE OXYFORGE MAY PERFORM AUTOMATED BACKUPS AS A COURTESY, THESE BACKUPS ARE PROVIDED ON A BEST-EFFORT BASIS ONLY AND ARE NOT GUARANTEED. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- OXYFORGE IS NOT RESPONSIBLE OR LIABLE FOR THE BACKUP, PRESERVATION, INTEGRITY, OR RECOVERY OF ANY OF YOUR DATA, FILES, DATABASES, EMAILS, CONTENT, OR ANY OTHER INFORMATION STORED ON OUR SERVERS.
- Automated backups may fail, become corrupted, be incomplete, or be unavailable at any time without notice.
- Backups may be overwritten, deleted, or become inaccessible due to server maintenance, hardware failures, software updates, third-party provider issues, or any other reason.
- Oxyforge does not verify the completeness or integrity of any backup.
- In the event of data loss — whether caused by hardware failure, software error, human error, security breach, account termination, natural disaster, third-party provider failure, or any other cause whatsoever — Oxyforge shall bear no liability for such loss.
9.2 Your Backup Responsibility
IT IS YOUR SOLE AND EXCLUSIVE RESPONSIBILITY TO MAINTAIN INDEPENDENT, OFF-SITE BACKUPS OF ALL YOUR DATA AT ALL TIMES. We strongly recommend that you:
- Maintain regular, independent off-site backups using your own backup solutions or reputable third-party backup services
- Download and store copies of all critical files, databases, and emails to your own local storage or a separate cloud storage provider
- Use cPanel’s built-in backup tools to create and download manual backups on a regular schedule
- Verify the integrity and completeness of your backups periodically
- Never rely solely on Oxyforge’s server-side backups as your only backup strategy
BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE BEEN ADVISED OF THE IMPORTANCE OF MAINTAINING YOUR OWN BACKUPS AND ACCEPT FULL RESPONSIBILITY FOR ANY DATA LOSS, REGARDLESS OF CAUSE.
10. Intellectual Property
All trademarks, logos, service marks, and branding associated with Oxyforge are our exclusive property. You may not use, reproduce, or distribute our intellectual property without our prior written consent.
cPanel is a registered trademark of cPanel, L.L.C. WordPress is a registered trademark of the WordPress Foundation. Google Cloud is a trademark of Google LLC. Cloudflare is a trademark of Cloudflare, Inc. All other trademarks belong to their respective owners.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF MALAYSIA, SINGAPORE, AND ANY OTHER APPLICABLE JURISDICTION, OXYFORGE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business opportunities, or goodwill
- Cost of procurement of substitute services
- Any damages arising from service interruptions, data loss, or security breaches
- Any damages arising from the actions or omissions of third-party providers, including but not limited to Google Cloud Platform, Cloudflare, payment processors, and domain registrars
- Any damages resulting from unauthorized access to or alteration of your data or transmissions
IN NO EVENT SHALL OXYFORGE’S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO OXYFORGE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF OXYFORGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless Oxyforge, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use or misuse of our Services
- Your violation of these Terms or any applicable law
- Your infringement of any third-party rights, including intellectual property rights
- Any content you host, upload, or transmit using our Services
- Any dispute between you and a third party relating to your hosted content or services
13. Suspension and Termination
We may suspend or terminate your account at any time, with or without notice, if:
- You breach any provision of these Terms
- Your payment is overdue
- Your use of Services poses a security risk to our infrastructure or other customers
- We are required to do so by law, regulation, or order of any governmental authority in Malaysia, Singapore, or any other jurisdiction
- We discontinue the Services (with reasonable notice where practicable)
You may cancel your account at any time by contacting us at [email protected]. No refunds will be issued upon cancellation (see Section 7). Upon termination, you must cease all use of the Services. We may delete your data after termination, and you are solely responsible for downloading and backing up all data prior to cancellation or termination.
14. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
OXYFORGE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. OXYFORGE DOES NOT WARRANT THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICES.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Malaysia. For customers based in Singapore, the applicable provisions of Singapore law shall also apply where relevant.
Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. For Singaporean customers, disputes may alternatively be resolved in the courts of the Republic of Singapore, at Oxyforge’s sole discretion.
The parties agree to comply with all applicable international laws, treaties, and conventions relevant to the provision and use of hosting services, including but not limited to intellectual property laws, data protection regulations, and electronic commerce legislation.
Before initiating any legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
16. Modifications to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Material changes will be communicated via email or a prominent notice on our website. Your continued use of our Services after any modifications constitutes your acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction in Malaysia, Singapore, or any other applicable jurisdiction, the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Oxyforge regarding the use of our Services and supersede all prior agreements, representations, and understandings, whether written or oral.
