Terms of Use

1. Acceptance Of Terms

By accessing, browsing or using the Oxyforge website and hosting services (together, the "Services"), you acknowledge that you have read, understood and agree to be bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Services.

These Terms are a legally binding agreement between you ("Customer", "you") and Oxyforge ("we", "us"). They are governed by the laws of Malaysia and, where relevant, the applicable provisions of the law of the Republic of Singapore.

2. Description Of Services

Oxyforge provides managed WordPress hosting on Google Cloud infrastructure in Singapore. The Services include:

  • Hosting and automatic provisioning of WordPress websites, each in its own isolated container
  • A members area for managing your websites, domains, backups, staging copies and usage
  • Server-level page caching and an object cache, managed by us
  • Domain connection and DNS guidance, with SSL certificates issued and renewed automatically
  • Daily automated backups with restore, and backups you can take on demand, subject to Section 10
  • Staging copies with push to live, and password-protected development sites
  • File and code access over SFTP and WP-CLI
  • Automated malware scanning and platform-level security measures
  • Transactional email sending from your websites, within the fair use limits in Section 6
  • Technical support through the members area

The Services do not include email mailboxes or email hosting, a control panel such as cPanel, root or shell access to the underlying servers, hosting for applications other than WordPress, or domain name registration.

3. Account Registration And Security

To use the Services you must create an account. You agree to:

  • Provide accurate, current and complete information when you register
  • Keep your account information up to date
  • Keep your credentials, SSH keys and SFTP passwords confidential
  • Accept responsibility for everything done under your account, including by people you invite to it
  • Tell us immediately at hello@oxyforge.com if you believe your account has been accessed without your authority

You must be at least 18 years old to hold an account.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with the laws of Malaysia, Singapore and any other relevant jurisdiction. You must not use the Services to:

  • Host, distribute or transmit content that is illegal, harmful, threatening, abusive, defamatory or obscene
  • Distribute malware, viruses or any other malicious code
  • Send unsolicited bulk email, or operate phishing or deceptive schemes
  • Infringe the intellectual property rights of others
  • Host content related to illegal gambling, piracy or fraud
  • Attempt to gain unauthorised access to other systems, networks or accounts, including other customers' websites on the platform
  • Mine cryptocurrency, run proxies, or run any process that consumes server resources out of proportion to serving your website
  • Store or distribute child sexual abuse material or any exploitative content
  • Breach data protection law, including the Singapore PDPA 2012 and the Malaysian PDPA 2010
  • Interfere with the integrity or performance of the Services

We may suspend or terminate an account immediately and without notice where we determine that this policy has been breached.

5. Migration Of Existing Websites

Moving an existing website onto the Services is your responsibility. We do not perform migrations on your behalf. Every website you create is given a temporary address so that you can transfer it, test it and confirm it works before you change any DNS record, and your previous host remains in your control throughout. We provide SFTP and WP-CLI access, and standard WordPress migration plugins work normally. Support can answer questions about the platform, but will not carry out the move for you.

6. Resources, Fair Use And Email

Each plan includes an allowance for the number of websites, storage and monthly outbound bandwidth. Storage counts your files and your databases together. Storage and bandwidth are pooled across the websites on your account, and you may set a cap on any individual website from the members area.

CPU, memory and process limits apply to each website. Sustained use that degrades the platform or other customers may result in throttling, a request that you move to a higher plan, or suspension in cases of repeated or severe abuse. Every website also has a ceiling on its rate of outbound traffic, which exists to limit the damage a compromised website can do.

Transactional email sent by your websites, such as password resets, order confirmations and contact form notifications, is included as a courtesy within a monthly fair use limit per website. It is not a bulk email or marketing service. We may rate limit, cap or suspend sending from a website that exceeds the limit or that sends unsolicited mail. For newsletters, campaigns or any significant volume you should connect your own SMTP provider, in which case your mail does not pass through us and no allowance applies.

We will make reasonable efforts to notify you before acting on a limit, except in an emergency or a case of severe abuse.

7. Payment And Billing

Fees are stated in the currency displayed at the time of purchase and are payable in advance for the billing cycle you select. Payments are processed by our third-party payment provider, and we do not store complete card details.

Failure to pay by the due date may result in suspension or termination without further notice. We may change pricing on at least 30 days' notice, and a change applies from your next billing cycle.

8. Refunds

All fees paid to Oxyforge are non-refundable. This includes hosting fees for any billing cycle, domain fees, add-on services and upgrades, and any other charges on your account.

By purchasing a Service you accept that no refunds or credits are issued, including for dissatisfaction, early cancellation, suspension following a breach of these Terms, or not using the Service during a paid period. A free trial website is available before you pay, and you are encouraged to use it.

If you raise a chargeback or payment dispute, we may suspend or terminate your account immediately and recover amounts owed, including administrative costs arising from the dispute.

9. Availability

We work to keep the platform available and we monitor it continuously. You acknowledge that our availability commitment excludes, and that we are not liable for, interruption or degradation arising from:

  • Scheduled maintenance, updates, patches and upgrades, which may occur with or without prior notice
  • Emergency maintenance to address a security vulnerability or a critical fault
  • Faults at third-party providers, including Google Cloud, Cloudflare, content delivery networks, DNS providers, domain registrars and upstream networks
  • Network outages or routing problems beyond our control
  • Denial-of-service attacks or other malicious activity directed at our infrastructure or at your website
  • Force majeure, including natural disaster, pandemic, government action, war, terrorism, power failure and telecommunications failure
  • Your own applications, scripts, plugins, themes, custom configuration or third-party software
  • DNS propagation delays
  • Any regulatory or governmental action requiring interruption of service

OXYFORGE MAKES NO GUARANTEE OF UNINTERRUPTED, ERROR-FREE OR CONTINUOUS SERVICE AVAILABILITY. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU ACKNOWLEDGE THAT TEMPORARY INTERRUPTIONS WILL OCCUR AND AGREE THAT OXYFORGE SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES OR COSTS ARISING FROM THEM.

10. Your Content, And Backups

You retain full ownership of the content and data you upload. We claim no intellectual property rights over it.

10.1 What we provide

We take an automated backup of each production website every day and retain the last 30 days, and you can restore a backup, or just its files or just its database, from the members area. You can also take a backup on demand at any time. Backups are held for restoring and are not offered as a download; you can take your own copy of a website's files over SFTP and of its database with WP-CLI at any time.

10.2 What we do not warrant

Backups are an operational safeguard we run for our own resilience and offer to you as a convenience. They are not a data protection service, and they are not a substitute for your own backups.

ANY BACKUP MAY FAIL, BE INCOMPLETE, BE CORRUPTED, BE OVERWRITTEN OR BE UNAVAILABLE, AT ANY TIME AND WITHOUT NOTICE. WE DO NOT WARRANT THE EXISTENCE, COMPLETENESS, INTEGRITY, RETENTION OR RECOVERABILITY OF ANY BACKUP, AND WE DO NOT VERIFY THAT ANY BACKUP CAN BE RESTORED. A RESTORE IS ATTEMPTED ON A BEST-EFFORT BASIS AND MAY NOT SUCCEED.

YOU MUST NOT RELY ON OUR BACKUPS AS YOUR ONLY COPY OF YOUR DATA. OXYFORGE SHALL BEAR NO LIABILITY WHATSOEVER FOR ANY LOSS, CORRUPTION OR UNAVAILABILITY OF DATA, FILES, DATABASES OR CONTENT, OR FOR ANY FAILED, MISSING OR UNUSABLE BACKUP, HOWEVER CAUSED, INCLUDING WHERE CAUSED BY HARDWARE FAILURE, SOFTWARE ERROR, HUMAN ERROR, OUR OWN ACT OR OMISSION, A SECURITY BREACH, SUSPENSION OR TERMINATION OF YOUR ACCOUNT, A THIRD-PARTY PROVIDER, OR FOR NO IDENTIFIABLE REASON AT ALL. THIS APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS, AND OUR TOTAL LIABILITY IN ANY EVENT REMAINS LIMITED BY SECTION 12.

We may change the backup schedule, the retention period or the restore mechanism at any time, and nothing in these Terms or on our website obliges us to hold a backup of any particular website at any particular moment.

10.3 Your responsibility

MAINTAINING AN INDEPENDENT, OFF-SITE BACKUP OF ALL YOUR DATA AT ALL TIMES IS YOUR SOLE RESPONSIBILITY. By using the Services you confirm that you have been told this and that you accept full responsibility for any data loss, regardless of cause. We strongly recommend that you:

  • Take a copy of each website's files and database periodically and keep it somewhere outside the platform
  • Take a backup on demand before updating a theme, a plugin or WordPress itself
  • Keep your own copies of anything you could not recreate
  • Verify from time to time that a backup you hold actually restores

When you delete a website it is taken offline and removed from your account immediately. We retain an archived copy of its files and database for 30 days, during which you may ask us through a support ticket to restore it; we may remove the archive permanently after that period. You cannot reverse a deletion yourself, and you remain responsible for taking a copy of anything you want to keep.

11. Intellectual Property

All trademarks, logos, service marks and branding associated with Oxyforge are our property. You may not use, reproduce or distribute them without our prior written consent. WordPress is a registered trademark of the WordPress Foundation. Google Cloud is a trademark of Google LLC. Cloudflare is a trademark of Cloudflare, Inc. All other trademarks belong to their respective owners.

12. Limitation Of Liability

To the maximum extent permitted by the laws of Malaysia, Singapore and any other applicable jurisdiction, Oxyforge and its directors, officers, employees, agents, partners and affiliates are not liable for:

  • Indirect, incidental, special, consequential or punitive damages
  • Loss of profit, revenue, data, business opportunity or goodwill
  • The cost of procuring substitute services
  • Damages arising from service interruption, data loss or a security breach
  • Damages arising from the acts or omissions of third-party providers, including Google Cloud, Cloudflare, payment processors and domain registrars
  • Damages resulting from unauthorised access to or alteration of your data or transmissions

IN NO EVENT SHALL OXYFORGE'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU TO OXYFORGE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND EVEN IF OXYFORGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless Oxyforge, its officers, directors, employees, agents and affiliates against claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or connected with your use or misuse of the Services, your breach of these Terms or of any law, your infringement of third-party rights, any content you host or transmit, and any dispute between you and a third party relating to your hosted content.

14. Suspension And Termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, your payment is overdue, your use poses a security risk to the platform or to other customers, we are required to do so by law, or we discontinue the Services, in which case we will give reasonable notice where practicable.

You may cancel at any time from the members area or by writing to hello@oxyforge.com. No refund is issued on cancellation, see Section 8. On termination you must stop using the Services. We may delete your data after termination, and you are responsible for downloading anything you wish to keep beforehand.

15. Disclaimer Of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. OXYFORGE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED.

16. Governing Law And Disputes

These Terms are governed by and construed in accordance with the laws of Malaysia. For customers based in Singapore, the applicable provisions of Singapore law also apply where relevant. Disputes are subject to the exclusive jurisdiction of the courts of Malaysia, and for Singaporean customers may alternatively be resolved in the courts of the Republic of Singapore at our discretion.

Before starting proceedings, the parties agree to attempt to resolve a dispute by good-faith negotiation for at least 30 days.

17. Changes To These Terms

We may modify these Terms. Changes are posted here with a new effective date, and material changes will be communicated by email or by a prominent notice on the website. Continuing to use the Services after a change means you accept the revised Terms.

18. Severability

If any provision of these Terms is found invalid, illegal or unenforceable, the remaining provisions continue in full force.

19. Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and Oxyforge regarding the Services, and supersede all prior agreements and understandings.
